Very simple, intention to make a profit, right? If your intention isn't to make a buck off copyrighted material, there isn't a real premise for criminal intent, when you're sharing files. You don't offer, you don't push, you don't deal in copyright material. Legislation should make a difference between Piracy(or Malware and such), and Filesharing. Let them focus on real criminal acts on and through the Internet. Phising, creditcard fraud, virï, malware, bots, hate sites, violence through internet, SPAM, and last but not least; Invasion of privacy by any and all(Governements, multinationals, corporate establishment).
